A tenancy agreement in Malaysia is a legally binding contract under the Contracts Act 1950. It must be stamped by LHDN within 30 days of signing to be admissible as evidence in court. Stamp duty is RM1 per RM250 of annual rent exceeding RM2,400 for tenancies under 1 year, RM3 per RM250 for 1 3 year tenancies. A standard security deposit is 2 months' rent, with a utility deposit of 0.5 months' rent. Landlords may only enter the property with 24 hours' notice except in emergencies. Without a stamped agreement, a landlord cannot take a tenant to court or initiate eviction proceedings.

A landlord in Malaysia cannot evict a tenant without a valid court order under the Distress Act 1951. A properly served Notice to Quit is the first legal step. Without a stamped tenancy agreement, the landlord has no legal standing in court. The standard notice period for a 12-month tenancy is 2 months. Landlords can legally deduct from the security deposit for unpaid rent, damages beyond fair wear and tear, and utility bills but must provide itemised receipts. Security deposit must be returned within 30 days of vacant possession.
