Stamp duty on a tenancy agreement is calculated at RM1 per RM250 of annual rent exceeding RM2,400 for tenancies under 1 year, RM3 per RM250 for 1 to 3 year tenancies, and RM5 per RM250 for tenancies over 3 years. Each copy of the agreement costs an additional RM10. Standard practice is two copies, one for each party.

Payment must be made via MyStamp on the LHDN website within 30 days of signing. A tenancy agreement that has not been stamped cannot be used as evidence in court and is not legally enforceable.

Example calculation
Monthly rent RM2,000, 12-month tenancy, 2 copies:

Annual rent = RM2,000 x 12 = RM24,000
Excess above RM2,400 = RM24,000 - RM2,400 = RM21,600
Stamp duty = (RM21,600 / 250) x RM1 = RM86.40
Rounded up = RM87
2 copies = RM87 + RM10 + RM10 = RM107 total

Stamp duty questions answered

An unstamped tenancy agreement cannot be submitted as evidence in court. This means if your tenant doesn't pay or causes damage, you have no legal document to rely on. Stamping protects both landlord and tenant. You can still stamp a late agreement but a penalty may apply.
By convention in Malaysia, both parties share the cost equally. The landlord pays for one copy and the tenant pays for the other. However, this is negotiable and some landlords absorb the full cost, particularly in competitive rental markets.
Payment is made via MyStamp on the LHDN website (hasil.gov.my). You upload the tenancy agreement, fill in the details, and pay online. The stamped certificate is returned digitally. Payment must be within 30 days of signing. Alternatively, Tanpa Ejen can handle the full submission for RM79 via WhatsApp.
Stamp duty only applies on annual rent that exceeds RM2,400. This means if your annual rent is RM2,400 or less (RM200/month or less), stamp duty on the tenancy portion is zero. You still pay RM10 per copy of the agreement. Most rental properties in KL and Selangor are well above this threshold.
